RESOLUTION AGE 7/2004

THE GENERAL ASSEMBLY OF THE INTERNATIONAL VINE AND WINE OFFICE,

DECIDES by consensus to recommend to the Inaugural General Assembly of the International Organisation of Vine and Wine the following draft resolution for adoption by consensus:

Draft Resolution AG 11/2004

The General Assembly of the International Organisation of Vine and Wine during its first meeting,

IN VIEW OF Article 3 paragraph 5 of the Agreement of 3 April 2001 which provides that the O.I.V may also include observers who shall be admitted after they agree in writing to the provisions contained in this Agreement and in the Internal Rules,

IN VIEW OF the draft Internal Rules of the International Organisation of Vine and Wine, which in its current draft provides the following provisions:

3-2 –Observers may be:

a A sovereign State non-member of the OIV.  Beyond a period which shall not exceed five uninterrupted years, the observer State is invited to submit an application to join the Organisation.

b) A territory or a group of territories belonging to a non- OIV member state not responsible for their international relations, after prior agreement of the concerned State.

c) An international non-governmental organisation with an interest in vines, wine, table grapes, raisins and other vine-based products or with an interest in related subjects, following the advice of the Scientific and Technical Committee.

 

3.3 - All requests for “Observer status” shall be presented by the Director General to the Executive Committee for approval

3.4 – Those granted "Observer status" may attend the work of the General Assembly, and may intervene in the work sessions of the commissions, sub-commissions, and experts groups.

3.5 – Those granted “Observer status” shall pay an annual financial contribution equal to the member states’ “basic vote”. In the case that three successive annual contributions have not been paid, the Director General shall notify those granted  “Observer Status”.. If the situation is not regularised during the two years following the thirty-first of December of the third year of non-payment, those concerned, granted “Observer Status” shall be automatically excluded from the Organisation.

3.6 – All those granted “Observer status” may decide to withdraw from the organisation with six months advance written notice addressed to the Director General of the O.I.V. It is indebted for its contribution, calculated pro rata temporis, at the effective date of its withdrawal

WHEREAS all observers of the International Vine and Wine Office have received a call for funds on a 2 ½ month prorata temporis basis until the first General Assembly of the International Organisation of Vine and Wine,

DECIDES to allow all observers of the International Vine and Wine Office to attend the works of the General Assembly and to intervene in the works of the Commissions, Sub-Commissions and experts groups at the March 2004 meetings

DECIDES to forward the provisions of the Agreement of 3 April 2001 to observers in order to receive their acceptance of these provisions which would be the equivalent of a membership application for observer status with the International Organisation of Vine and Wine,

DECIDES that the Executive Committee shall review these membership applications for observer status with the International Organisation of Vine and Wine and shall adjudicate the applications,

DECIDES that those granted "observer status " shall have to pay a financial contribution "ex tunc" equal to the contribution to be paid by the members, based on «basic  votes », 9 ½ months prorata temporis, in order to ensure the continuity of their participation.
