TRANSITION ARRANGEMENTS BETWEEN THE INTERNATIONAL VINE AND WINE OFFICE AND THE INTERNATIONAL ORGANISATION OF VINE AND WINE

THE GENERAL ASSEMBLY OF THE INTERNATIONAL VINE AND WINE OFFICE,

FOLLOWING the proposal of the Executive Committee,

CONSIDERING the procedure in progress of acceptance, approval, ratification or accession concerning the Agreement of 3 April 2001 creating the « International Organisation of Vine and Wine » the entry into force of which is conditional upon the deposit of thirty one instruments of acceptance, approval, ratification or accession;

CONSIDERING that the elections for the positions of President, Presidents of Commissions and Director General of the «International Vine and Wine Office» should take place during the General Assembly planned in Paris in June 2003;

CONSIDERING that the elections for the positions of President and Vice-Presidents of the Sub-commissions and expert groups should take place at the earliest during the technical work sessions of the «International Vine and Wine Office» planned in March 2004;

IN VIEW OF THE DECISION of the Executive Committee fixing the deadlines for presenting candidacies;

DECIDES to undertake the procedure of calling for candidates for the renewal of the elective mandates of the « International Vine and Wine Office » during the 83rd General Assembly of the « International Vine and Wine Office » which will be held in June 2003,

AUTHORISES the 83rd General Assembly of the « International Vine and Wine Office » which will be held in June 2003 to determine on the date of its meeting the number of instruments of acceptance, approval, ratification or accession concerning the Agreement of 3 April 2001 which have actually been deposited,

DECIDES that:

  1. If on the date of the 83rd General Assembly of the « International Vine and Wine Office », the number of 31 instruments of acceptance, approval, ratification or accession deposited concerning the Agreement of 3 April 2001 is not reached, the elections shall be held under the conditions defined by the Internal Regulations of the “International Vine and Wine Office”;
  2. If on the date of the 83rd General Assembly of the « International Vine and Wine Office », the number of 31 instruments of acceptance, approval, ratification or accession concerning the Agreement of 3 April 2001 is reached, the elections shall not be held. The President, Vice-Presidents, Presidents of Commissions and the Director General of the « International Vine and Wine Office » will have their terms of office extended until  31 January 2004. The Director General of the “International Vine and Wine Office” is authorised to convene and organise the first General Assembly of the “International Organisation of Vine and Wine” before 31 January 2004, which will appraise the situation and take the appropriate decisions.
  3. However, in the interests of good management and by derogation to the provisions envisaged in point 1 above, the General Assembly in June 2003 may decide, taking into account an objective examination of the situation, including in particular the outlook for  acceptances, approvals, ratifications or accessions of the Agreement of 3 April 2001 during the forthcoming six month period until 31 December 2003, to postpone the elections to a date which in any case should not be after 31 January 2004. If this exceptional procedure is applied, the mandates of the President, the Vice-Presidents, the Presidents of Commissions and the Director General shall therefore be extended until 31 January 2004 in order to allow the Director General to convene and organise, before this date, either an Extraordinary General Assembly of the "International Vine and Wine Office" if 31 instruments acceptance, approval, ratification or accession concerning the Agreement of 3 April 2001 are still not deposited or the first constitutive General Assembly of the "International Organisation of Vine and Wine" if the number of 31 instruments is reached.

ENTRUSTS the Director General of the "International Vine and Wine Office" with the task of determining on 31 December 2003 at the latest the number of instruments of acceptance, approval, ratification or accession concerning the Agreement of 3 April 2001 which have actually been deposited,

And, if elections have been held during the General Assembly of June 2003,

DECIDES that:

  1. If on 31 December 2003 the number of 31 instruments of acceptance, approval, ratification or accession deposited concerning the Agreement of 3 April 2001 is still not reached, the new Director General of the « International Vine and Wine Office » will take up his functions on 1 January 2004.  The Presidents and Vice-Presidents of the Sub-commissions and expert groups will be elected under the usual conditions in March 2004,
  2. If on 31 December 2003 the number of 31 instruments of acceptance, approval, ratification or accession deposited concerning the Agreement of 3 April 2001 is reached, the new Director General of the « International Vine and Wine Office » will take up his functions on 1 January 2004. The new Director General of the « International Vine and Wine Office » is authorised to convene and organise the first General Assembly of the « International Organisation of Vine and Wine » before 31 January 2004, which will appraise the situation and take the appropriate decisions.
