ADOPTION PROCEDURE FOR STANDARDS

THE GENERAL ASSEMBLY,

IN VIEW of the Executive Committee's proposal, after advice of the Scientific and Technical Committee;

CONSIDERING the need to specify the procedure for the adoption of recommendations or resolutions, adopts the rule thus modified.

CHAPTER ONE

THE GENERAL ASSEMBLY

Article One.-

The General Assembly has competence for :

  1. defining a general wine growing and viticultural policy in formulating the recommendations which will be submitted to the Member States for approval.

Except for those which are proposed by the Executive Committee and in the exceptional case of urgent questions from a Commission or the General Assembly itself, the resolutions or recommendations which may or may not take the form of international standards are submitted to vote by the General Assembly, following the procedure below:

Step 1: A new work area for an Expert Group or Sub-Commission arises from one of the following sources:

  • from within the Expert group or Sub-Commission or Commission; þ from the Scientific and Technical Committee;
  • from the Executive Committee;
  • from the General Assembly itself;
  • from the Director General, at the request of a member country or symposium under O.I.V. patronage.

The setting of the agenda on the subject of the work is decided by the group or the Sub- Commission under the proposal of its president.

Step 2: A restricted ad-hoc "drafting or consulting group", comprising the chair of the appropriate group or sub-commission (President of the Expert Group or Sub-Commission, Vice-President, Secretary or Director General) with the possible participation of certain national experts having particular interest or expertise in the given topic, prepares a Proposed Draft Resolution.

The "feuillets verts" of the Sub-Commission on the methods of analysis currently constitute these Proposed Draft Resolutions. They are drawn up by an expert reporter. In this case, the "restricted meeting" is replaced by the "feuillets verts", which are then placed on the agenda of the aforementioned Sub- Commission only after the agreement of its chair; a similar procedure can be followed by the Sub-Commission on Nutrition and Health.

Step 3: The Director General of the O.I.V. circulates the Proposed Draft Resolution to member countries, collates any comments received and circulates them to member countries in time for the next expert group or sub-commission meeting.

Step 4: At the expert group or sub-commission meeting, the Proposed Draft Resolution and the comments received are discussed and a revised text (Draft Resolution) is prepared. The president of the Expert Group or the Sub-Commission in agreement with the chair may decide, taking account of the consensus of the Group or Sub-Commission, to advance the Draft Resolution directly to step 7 or to pass it to step 5 or to withdraw it.

Step 5: The Director General of the O.I.V. circulates the Draft Resolution to member countries, collates any comments received and circulates them to member countries in time for the next expert group or sub-commission meeting.

Step 6: At the expert group or sub-commission meeting, the Draft Resolution and the comments received are discussed and a revised text is prepared for submission to the appropriate Commission. The decision to submit the Draft Resolution to the Commission shall be taken by the President of the Expert Group or Sub-Commission, in agreement with the chair, taking account of the consensus of the Group or Sub-Commission. If there is no agreement for a given proposal, it may be modified and returned to Step 5.

Step 7 : The Commission considers the Draft Resolution and any representations made at the Commission meeting. A final form of the text is prepared for submission to the General Assembly. The decision to submit the text to the General Assembly shall be taken by the President of the Commission, in agreement with the chair or the Draft Resolution may be returned to Step 5.

Step 8: The General Assembly receives the final Draft Resolution from member countries, amends it if necessary and then votes on the Draft Resolution. If the Resolution fails to achieve the required majority, the General Assembly may decide to return it to Step 5.

The provisions of other articles of the rule, contrary or not conforming to the present provisions, are adapted when the need arises.
